In December of 1895 City prosecutor Kennedy stated in Police Court, "This man was not the conductor on this car; he was the motorman acting on the orders of the conductor. The evidence shows the conductor went ahead, and after signaling the motorman to go ahead pulled the derailing switch and allowed the car to pass through. We have every reason to believe that this man, Rogers, was doing his duty as ordered by the conductor, and no blame can be attached to him."
